Hello Ray,

I did provide a post on the Procurement Professional Website, but wanted to send you an e-mail as well. I am very interested to see the official update. You can either e-mail me or send me a hard copy of the final results.

With regards to Open Source Software ("OSS") I would like to see definitions for :
- Copyleft
- Tivoization
- Four Freedoms
- Viral OSS

Additionally...what is the key GPL restriction for OSS.

Ray, I was able to sell Microsoft office licenses via Used Software in Germany. When you put out the 1st bill of rights, you mentioned that you thought #36 was not possible. It is now!

Check out Frank Scavo's insights based on Ashok's question. Great point on planning to get out with SaaS before you get in!

Picking up on Ashok's comment, I am concerned about the higher level of vendor lock-in for SaaS providers. There is no option to go "off maintenance" and continue to run the software. Therefore, with SaaS providers that offer an on-premise version (e.g. Oracle On-Demand), there should be conversion terms to transition to the on-premise version.

For SaaS providers that do not offer an on-premise deployment option (e.g. Salesforce.com), there needs to be the right to extract all master file and transactional data to an open format (e.g. XML), so as to facilitate conversion to a new SaaS or on-premise solution.

How about product liability in software? Typically excluded. What if licensed "compliance software" is buggy? Whose problem is it?

With SaaS, we need to have some rules on ownership of data. I'm including metadata, process data, etc. It's useless having just the data with no context. You may want to think about how to address this. BTW, thanks for all your help with my Oracle ELA last year. Appreciate it! - AG

Hey Ray! hope all's well. We met at Sapphire 2008 and thanks for your advice. One of the big developments in Germany is the right to buy remarketed software. I think that should be a right as well to be included. You might want to take a look at this market. I'll DM you later.
